HDomestic Ltd. Terms and Conditions Agreement These Terms and Conditions of Business are between HDomestic Ltd. and an employer (the Client) and are deemed to be accepted by the client by virtue of the use or engagement of a person (the Applicant) introduced or supplied to the Client by HDomestic Ltd. For the purposes of this agreement, persons booked for employment through The Agency are referred to as “Employees” and persons who contract with The Agency are referred to as “Employers”. The Agency will endeavour to introduce to the Employer, Employees on The Agency register who have been carefully selected through interview and by referral to references submitted. The following terms and conditions apply to all bookings made by or through The Agency: Fees Option 1 - The Employer opts to pay an agreed monthly subscription by debit or credit card. The Agency shall be entitled to charge the Client at the beginning of each month in which the Service is provided, or at other times as agreed with the Client. If payment of the Fee is not made on the due date the Agency reserves the right to delay provision of the Services until payment has been received. Cancellation notice required: 1 month. Fees Option 2 - If a permanent, part time or temporary position results from introduction by The Agency, the following one off fees will apply: Permanent £400 or Part-time (Day) £295. One Off and TemporaryBookings: minimum transaction of £19.95 Fees are payable in full before the placement commences. Payment is taken the same or following day and confirmation of the transaction will be forwarded to the Employer’s address, when requested. In the event of a one-off fee being paid for a permanent position and the applicant leaving employment within eight weeks of commencing work then the Client will receive a free replacement guarantee. This means that every effort will be made to provide a suitable replacement. In the event of the client making alternative arrangements HDomestic Ltd. will provide a free replacement guarantee any time in the future. Employee’s Pay Employees shall be under the supervision, direction and control of the Employer. Should an Employee earn sufficient to become liable for Income Tax or National Insurance contributions, the Employer is responsible for making deductions under PAYE and returns to the Inland Revenue. The Employer is responsible for maintaining any records the Inland Revenue may require. The Agency acts as an introduction and booking agency only and does not employ the carers or other staff booked by Employers. Cancellation and Termination Either party shall be entitled to terminate this Agreement at any time by giving one months' written notice to the other party. Either party may (without limiting any other remedy) at any time terminate the Agreement by giving written notice to the other if the other commits any breach of these Terms of Business and (if capable of remedy) fails to remedy the breach within 30 days after being required by written notice to do so, or if the other goes into liquidation, or (in the case of an individual or firm) becomes bankrupt, makes a voluntary arrangement with his or its creditors or has a receiver or administrator appointed. Conditions In paying a membership fee the Employer undertakes to make all bookings with Employees through The Agency. Private approaches to Employees are not permitted. If an Employer is found to have made an offer of childcare employment to an Employee originally booked through The Agency the Employers membership will be cancelled and no further bookings will be accepted. Both Employer and Employee will be liable in damages to The Agency for compensation in respect of all past, present and future losses, which The Agency has suffered or might suffer by reason of any breach of the undertaking. The Employer undertakes to respect the Employee's right to privacy and agrees not to ask any Employee for a telephone number or contact address other than through The Agency. References given by Employees are verified with referees verbally as The Agency believes referees give a more full, frank and candid picture in discussion than they would if asked to provide information in writing. Employees shall always be under the supervision, direction and control of the Employer. The Agency cannot under any circumstances accept responsibility for the acts and omissions of Employees introduced, or for any loss, expense or damage arising for any reason there from. No responsibility or liability whatsoever can be accepted by Agency’s directors, employees or associates for any costs, claims, damages, losses, expenses or liabilities whatsoever and howsoever caused to the Employer or their property arising from any introduction or booking effected or attempted by or through The Agency. The Agency is unable to give, and does not give, and there is not to be taken or implied any warranty that an Employee is able to fulfil a booking made by or through The Agency, or that the Employee will be able to fulfil any employment offered by the Employer. While the Employer employs an Employee from an introduction made by The Agency the Employer undertakes to keep The Agency fully and effectively indemnified against all costs, claims, damages, expenses and liabilities whatsoever arising from the Employer’s act, omission, default or negligence. The Agency reserves the right to cancel any membership or booking at any time without notice and without reason. No refund of membership fees is payable, this also applies should The Agency be restructured, merged, transferred or closed. In case of any dispute English law shall apply. Terms and Conditions of Babysitting Please note that Bookings are for a minimum of 3 hours. Part hours are charged at the relevant hourly rate after the first 10 minutes. Time, attention and planning are made to complete your booking. Whilst HDomestic Ltd. acknowledges that unforeseen circumstances do occur, we do not give Agency Fee refunds for bookings made. Cancellations: Must be made the day before the booking date i.e. 48 hours notice, if not both the babysitter is payed a minimum of three hours work plus the agency fee. As HDomestic Ltd. acts as an agency for childcarers (The Employees) on their register, customers (The Employer) must respect the babysitters right to privacy and must agree not to ask any babysitter for a phone number or contact address other than through HDomestic Ltd. Employees shall always be under the supervision, direction and control of the employer. HDomestic Ltd. cannot under any circumstances accept responsibility for the acts and omission of employees introduced or for any loss, expense or damage arising for any reason there from. HDomestic Ltd. Policy is to interview childcarers face to face. References are checked and verified with child carer referees. Although not a legal requirement to screen babysitters through the Criminal Bureau, HDomestic Ltd. Policy is to check carers against the register to make sure they do not have a criminal record. This can take up to12 weeks and longer in some cases. If carers have been interviewed and we are satisfied that they meet all the necessary requirements to be a child carer but are still awaiting CRB clearance, we will in times of peak demand place them with families. HDomestic Ltd. is unable to give and does not give and there is not to be taken as implied any warranty that any employee is able to fulfil a booking made by or through HDomestic Ltd. or that she will be able to fulfil any employment offered. While the employer employs an employee from an introduction made by HDomestic Ltd. the employer undertakes to keep HDomestic Ltd. fully and effectively indemnified against all costs, claims, damages expenses and liabilities whatsoever arising from the employers act, omission, default or negligence. |
